Customs begin release of BYD vehicles

Sri Lanka Customs is releasing 991 BYD vehicles it held back due to a dispute over the motor capacity.

A senior official said the release of the vehicles began yesterday, following an agreement reached after considering the Court of Appeal application filed by the company John Keells CG Auto (Pvt) Ltd this week.

The case was taken up by Justice Rohantha Abeysuriya, President Court of Appeal and Justice K. Priyantha Fernando.

The Sunday Times learns that six of the vehicles will be held back—two each from three categories—to test the motor capacities.

The Court of Appeal this week accepted a proposal by the Sri Lanka Customs to appoint a specialised committee to examine the motor capacity of a particular BYD brand. The committee, consisting of two qualified staff members of the University of Moratuwa or the University of Peradeniya and two senior officials, one each from the Government Analyst’s Department and the Department of Motor Traffic, will inspect the detained vehicles and submit a report on whether the motor capacity is 100 kW or more.

In addition, the Customs Director General, in consultation with the Attorney General and subject to the approval of the Finance Ministry Secretary, will also obtain a report on the capacity by an internationally accredited automobile lab.

Upon completion of the process, if it is revealed that the capacity of the motor/motors exceeds 100 kW, the petitioner company shall bear the responsibility for such declarations made to Sri Lanka Customs, subject, however, to the legal remedies available to the petitioner.

Among the conditions was that
the company places a bank guarantee from a state-owned commercial bank to the value of Rs 3,552,909,200 written
in favour of the Customs
Director General.

Senior Additional Solicitor General Sumathi Dharmawardena appeared for the Sri Lanka Customs, while Farzana Jameel, PC, appeared for the company.
