Divisional Secretary fined for obstructing the Ambuluwawa cable car project

The Court of Appeal (CA) has issued a writ preventing Udapalatha Divisional Secretary Athma Dilrukshi Jayaratne from interfering or obstructing the Ambuluwawa cable car project.

The CA also ordered the Divisional Secretary to pay Rs 100,000 as legal costs from her personal funds to the petitioner company, Amber Adventure (Pvt) Ltd. It ruled that she had overstepped her authority to maliciously obstruct the project, being constructed with foreign investment, though the project had obtained necessary approvals from relevant institutions.

Delivering his judgement on the writ petition filed by the petitioner, CA Judge Gihan Kulatunga said officers of the Attorney General’s Department also had an obligation to properly study such matters and advice the relevant parties accordingly.

Appearing for the petitioner, Ali Sabry, PC, instructed by Attorney-at-Law Sanath Wijewardena, stated that the project site falls entirely within the jurisdiction of the Urban Development Authority (UDA) and that the Divisional Secretary had no legal authority to intervene.
