New three-judge panel sought for Immunoglobulin case

A request has been made to appoint a new three-judge High Court Trial-at-Bar to hear the case filed against 12 accused including former Health Minister Keheliya Rambukwella over the importation of counterfeit immunoglobulin injections and distributing them to hospitals.

President of the Trial-at-Bar Mahesh Weeraman is due to retire soon while High Court Judge Pradeep Abeyratne, another member of the Trial-at-Bar, has been transferred as Tangalle High Court Judge. That leaves only High Court Judge Amali Ranaweera, necessitating the appointment of a new Trial-at-Bar.

The case was called this week before the existing Trial-at-Bar, where the accused were served indictments. The bench rejected objections by Deputy Solicitor General Lakmini Girihagama, who led the prosecution and granted bail to all the accused. The court ordered the accused to be released on two cash bails of Rs 500,000 and two personal bails of Rs 5 million each. First accused Sudath Janaka Fernando, who had been in remand custody for 18 months since his arrest, was also released on bail.

The court also ordered the prosecution to call evidence so that the case can be heard in the absence of accused Dr Jayanath Buthpitiya, who is overseas. The case will be taken up again on October 10.
