BYD importer should grant access to Customs for vehicle inspection, AG tells court

The Attorney General’s Department, on behalf of Sri Lanka Customs, informed the Court of Appeal this week that the petitioner company John Keells Holdings should grant access and facilitate Customs to ascertain the motor capacity of BYD vehicles detained by it.
Additional Solicitor General (ASG) Sumathi Dharmawardena, appearing for the AG, agreed to release BYD Dolphin Standard – 49 kW and BYD Sealion 7 – 100 kW vehicles on a bank guarantee.
With regard to the suggestion for a corporate guarantee proposed by the petitioner company, ASG Dharmawardena said Customs was requesting further time to consider it.
He informed the court that the petitioner company imported scanners of the BYD vehicles, which are currently in the possession of Customs. He said Customs will provide details of these scanners by way of a motion on Monday (27).
Farzana Jameel, PC, appearing for the petitioner company, told court that the previously imported vehicle model was different from the current model. Both models however, had been detained by Customs. She requested the court to allow the release of the newer model.
The Court of Appeal bench, comprising President of the Court of Appeal President Rohantha Abeysuriya and Justice Priyantha Fernando, will consider the request on October 28.
