The Protection of Occupants Bill gets Cabinet nod

The Government will introduce a new bill to parliament to prevent a landlord from ejecting persons from occupation of premises.

The Protection of Occupants Bill has been given Cabinet approval and published in the Gazette by the Minister of Justice and National Integration.

The provisions of this Act will apply to a person who is in lawful occupation of premises and has been in undisturbed and uninterrupted occupation of
such premises for a period of more than three months.

Under the proposed law, it will be unlawful for a landlord to eject a occupant of a premises in contravention of the terms and conditions of any
lease agreement or tenancy agreement entered into between the landlord and the occupant in terms of the relevant
written law except by an order of a competent court.

It will also be unlawful for a landlord to discontinue amenities or facilities or to damage premises as means to oust an occupant.

The Rent Act, No. 7 of 1972 will be repealed once the new law comes into effect.
