Trump tariffs ruled unconstitutional, but will remain until October 14

The Trump administration’s unilateral tariffs have been ruled illegal by a United States appeals court and the ruling will take effect from October 14.
It is a decision that underlines principles in the US Constitution. However, a White House statement said the “tariffs remain in effect’’.
How the ruling on Friday by the US Court of Appeals for the Federal Circuit will affect tariffs already imposed on Sri Lanka is not immediately known. Sri Lanka has negotiated lower tariffs of 30% effective August 1, compared with 44% imposed earlier.
The court said that only the Congress has power to “impose taxes such as tariffs’’. The power is vested by the Constitution “exclusively in the legislative branch’’.
On its Facebook page, the non-profit Liberty Justice Center said President Donald Trump’s tariffs are “Unconstitutional’’.
The Trump administration could take the challenge next to the Supreme Court.
In late May, the US Court of International Trade rejected President Trump’s use of the International Emergency Economic Powers Act, to impose tariffs.
