Acquiring unclaimed Northern lands: SC interim order stops gazette

The Supreme Court has issued an interim order preventing the implementation of a gazette notification acquiring 5941 acres of land in the Northern Province for which no one has claimed ownership.
The SC issued the interim order after considering a fundamental rights petition filed by former Jaffna district MP M.A. Sumanthiran and applies to unclaimed land in the Jaffna, Kilinochchi and Mullaitivu districts.
The gazette was issued on March 28 declaring that all of the land mentioned for which legal ownership could not be proved by June 28 would be acquired by the state.
The interim order preventing the implementation of the gazette was issued by the SC bench comprising Justices Yasantha Kodagoda, Sampath Wijeratne and Sampath Abayakoon. It will be in effect until the conclusion of the hearing into the case.
The petitioner has pointed out that many of the owners of private lands in the North are currently overseas, while there is a lack of clarity surrounding the legal ownership of some other lands as well. Given this situation, the petitioner had argued that it would be a profound injustice for the people of the North and a violation of their fundamental rights if the said gazette notification were to be implemented.
