‘Structural changes’ await CC, Commissions

The move comes as it feels there are practical difficulties for the Government in carrying out the functions of these constitutional bodies.
The Sunday Times learns that the Government position is that appointments to the Constitutional Council and Independent Commissions were made by the previous government, and therefore it should be entitled to make a claim to make fresh appointments when a new prime minister and government are in office.
However, the proposed changes will most likely be introduced when the present terms of the Constitutional Council and each of the existing Independent Commissions end, it is further learnt.
For the Constitutional Council, a model where Council members could be appointed with the change of the prime minister or Cabinet is being considered.
Constitutional amendments will be brought in, according to the requirements, it is learnt.
These moves come after the Government has run into several issues regarding appointments, particularly through the Police Commission, the Public Service Commission and the Constitutional Council.
Accordingly, ‘structural changes’ and the manner in which the appointments are made to the Commissions and the Constitutional Council will be considered.
The Government has taken into consideration the fact that existing independent commissions have been formed in keeping with traditional laws, thereby reducing the efficiency of their functions.
“It is not possible to function efficiently by meeting once a week or occasionally to carry on with the work,” a senior official of the government pointed out.
“The government wants to function efficiently, but it has been difficult to work efficiently with some of the existing commissions,” he said, adding that there were delays in drawing responses from some of the independent commissions.
The Constitutional Council and the independent commissions were introduced by way of constitutional amendments following continued public agitation as a check and balance to the powers of the Executive Presidency.
