CA allows petition seeking nullification of Archchuna’s parliamentary seat

The Court of Appeal has granted leave to proceed to a petition filed seeking to nullify the Parliamentary seat of Jaffna District MP Ramanathan Archchuna.
However, the CA bench stated that it would not issue an interim injunction preventing MP Archchuna from sitting in Parliament, as requested in the petition.
The petition had been filed by Chairman of the “Abhinawa Nidahas Peramuna,” Oshala Herath.
The petition is scheduled to be taken up for hearing on August 1.
The CA bench comprising Justices Mayadunne Corea and Mahen Gopallawa gave the order after considering submissions made by all sides.
Attorney-at-Law Ashok Herath, appearing for the petitioner, told court that since the MP had been under interdiction when he was elected to Parliament, he was still a government official and as such, was disqualified from holding a Parliamentary seat.
Attorney-at-Law Senany Dayaratne, appearing for MP Archchuna, argued that since her client was already interdicted when he was elected as an MP, he could not be considered as a government official.
Additional Solicitor General Sumathi Dharmawardena, PC, who appeared for the Attorney General informed that the Director General of Health Services had confirmed that MP Archchuna was still a doctor serving in the government service when he was elected to Parliament.
