CC approves appointments of 2 judges to CA, does not consider SC appointment
The Constitutional Council (CC) has approved the recommendation to appoint senior High Court Judges Dr Frank Gunawardena and Adithya Kumara Patabendi to the Court of Appeal.
President Anura Dissanayake had forwarded the names of the two judges to the CC on the recommendation of Chief Justice Murdu Fernando.
Justice Gunawardena joined the judicial service as a magistrate in 1998 and holds a PhD in Constitutional Law. Justice Patabendi was appointed a magistrate in 2000 and is a graduate of the University of Colombo.
The CC, which met on Friday evening under Speaker Dr Jagath Wickramaratne, has, however, not considered the recommendation made by President Dissanayake to appoint Acting Court of Appeal President Mohammed Thahir Laffar as a Justice of the Supreme Court.
Sources said Justice Laffar’s nomination was not considered owing to an issue that arose over his nomination, and because a Supreme Court seat is yet to fall vacant.
However, Justice Gamini Amarasekara is to retire as a Supreme Court Justice on June 17 upon reaching 65 years; the retirement age of SC justices. Court of Appeal President Nissanka Bandula Karunaratne, who is currently on pre-retirement leave, is to retire tomorrow (16) upon reaching 63 years of age. Justice Laffar meanwhile, is to retire on June 18 after reaching 63 years. The retirements of Justices Karunaratne and Laffar next week would create two vacancies in the Court of Appeal.
The AG has recommended Senior Additional Solicitor General Rohantha Abeysuriya, PC, to be the next President of the Court of Appeal. The recommendation has been sent by the President to the CC.
