Seagull directors indicted in HC for breach of trust

The Directors of Seagull Property Developers (Pvt) Ltd, a company which builds condominium properties for sale, have been indicted in the High Court of Colombo for breach of trust.

The case was called up this week before High Court Judge Lalith Jayasuriya. The indictment has been served by the Attorney General’s Department under Section 403 of the Penal Code for “cheating and dishonestly inducting a delivery of a property”.

Between November 1, 2003, and April 2, 2010, Seagull Property Developers (Pvt) Ltd disposed of four flats in a condominium built at Wellawatte in exchange for Rs. 28,080,000 from a purchaser. The indictment says that the buyer had parted with the money through deception and that she would not have made the payment had she known the true facts about the business deal. It also charges the company with having acted in a premeditated manner and with having conspired to commit the crime.

Under Section 113(A) of the Penal Code, “If two or more persons agree to commit or abet or act together with a common purpose for or in committing or abetting an offence, whether with or without any previous concert or deliberation, each of them is guilty of an offence of conspiracy to commit or abet that offence, as the case may be”.

Charges are also filed under other sections relating to abetment and common intention. The indictment states that the three directors—Navaratnasingam Vakeesan, Navaratnasingam Surendran and Shanmugaratnam Thirubanantham—were involved in the crime.

The case will be taken up next year on January 18 and 19.
