Bold review of copyright laws pertaining to music and book publishing

Sri Lanka’s intellectual property authorities are planning bold reforms and possibly new legislation to strengthen copyright laws in Sri Lanka in the music industry and, at the same time, examine the copyright regime for the book publishing industry.

Seeking public opinion and views, the National Intellectual Property Office (NIPO), operating under the Ministry of Trade, Commerce, Food Security and Co-operative Development, says the exercise pertaining to copyright laws on music is aimed at strengthening the current regime of laws with a focus on ownership and non-exploitation of songs.

The NIPO, in a published public appeal, has sought views and feedback pertaining to creative ownership and attribution; economic rights and moral rights associate with songs; digital use of songs, distribution, streaming, downloads and online platforms; and measures to prevent and address copyright infringement online and offline.

The NIPO has invited musicians, composers, performers, record labels, collective management organisations, digital platforms, legal practitioners, academics and members of the public to participate in this national consultation.

Experts say the present laws – the Intellectual Property Act No 36 of 2003 – are outdated with the advent of a growing digital media segment and needs a serious update or enactment of a new law particularly in the case of copyright and abuse of one’s right in the music industry, with the same applying to original books.

Parallelly the NIPO is seeking views on copyright protection in the book publishing industry in Sri Lanka. It is welcoming feedback on editorial, printing and production standards that impact authors’ rights; fair publishing contracts, transparency and author rights; copyright practices in publishing and measures to reduce piracy; challenges and opportunities relating to digital publishing, e-books and other online distribution; and strengthening accountability, ethical conduct and professional standards within the publishing industry to enhance copyright protection,

The organisation has urged authors, publishers, printers, editors, booksellers, librarians, collective management organisations, educators, digital distributors, legal practitioners, academics and members of the public to participate in this discourse. In both cases, public views have been invited by the NIPO, on or before January 31, 2026.
