Demolition of historic building: SC blocks suspects’ second bid to avoid arrest

The Supreme Court (SC) has prevented former Kurunegala mayor and four other suspects from obtaining a second ruling from the Court of Appeal (CA) preventing their arrest after the SC had vacated an earlier such order issued by the CA.

Having considered submissions made by Deputy Solicitor General Madhawa Tennakoon over the case regarding the demolition of the Raja Sabha Mandapaya (Royal Assembly Hall) of King Buwanekabahu in Kurunegala, the SC issued an order preventing the CA from considering the five writ petitions filed by the suspects until further notice.

DSG Tennakoon told the SC it was problematic as to why the police had so far failed to arrest the suspects despite the SC vacating the CA’s earlier order preventing their arrest. He further pointed out that the suspects cannot file fresh writ petitions asking the CA to issue the same order that had earlier been vacated by the highest court of the land.

Meanwhile, the AG indicted five accused including former Kurunegala Mayor Thushara Sanjeewa in the Kurunegala High Court on 14 counts under the Antiquities Ordinance and the Public Property Act over the destruction of King Buwanekabahu’s Royal Assembly Hall.
