Maligawatte temple arms case: Report ready, State moves for time

Investigations have been concluded and the report forwarded to the Attorney General’s Department in a case where the temple at Maligawatta, Maradana was raided and the chief incumbent arrested by the CID for possession of arms and ammunition, Senior State Counsel Riyaz Hamza informed the Supreme Court and moved for time.

Attorney J.C. Weliamuna appearing for the petitioner Ven. Uvathenne Sumana Thera citing Chandana De Silva, Officer in Charge CID, D.B.U. Kodituuwakku, Commanding Officer Police Task Force, Defence Secretary Gotabaya Rajapaksa and the Attorney General as respondents, said that the raid was well planned and the production was introduced by the CID.

He stated that the petitioner was a supporter and an organizer of several events in support of the UPFA. He was an ardent supporter of President Mahinda Rajapaksa in the election held in 2005.

The petitioner stated that after he found various malpractices and corruption that was taking place in the UPFA he switched his support to the common candidate Sarath Fonseka who contested the Presidential election against President Mahinda Rajapaksa in 2010.

He also organized a mass rally of Buddhist monks at Vihara Mahadevi Park against the President and this unlawful arrest and detention which violated his fundamental rights were totally politically motivated.
The petitioner requests the Court under these circumstances that he be released on bail.

The Bench comprising acting Chief Justice Shirani Bandaranayake Justices Gamini Amaratunga and Ms. Chandra Ekanayake was of the view that the Supreme Court is not in a position to grant bail at this juncture and that the petitioner should wait for the trial.
