Magistrate dismisses private plaint against top police officers

Fort Magistrate Thilina Gamage gave an order on Friday, dismissing a private plaint filed against Senior Superintendent of Police (SSP) Roshan Dias and Assistant Superintendent of Police (ASP) Nalin Diruk over the disruption of a protest march in Colombo.

On November 8, State Counsel Shaminda Wickrema appearing for the Attorney General (AG) strongly objected to the private plaint. He said that material had been suppressed by the complainant and that the AG’s sanction was essential to file a private plaint.

Saliya Pieris PC, who appeared for the complainant said there was no suppression and no unlawful assembly.

After taking the facts into consideration, Magistrate Thilina Gamage held that the AG’s position was correct. He held that the officers had acted lawfully and even filed a further B Report proving their bona fides.

The Magistrate ruled that not seeking the AG’s sanction was fatal and dismissed the case.

State Counsel Shaminda Wickrema, Malik Azeez and Nisith Abeysooriya appeared for the Attorney General.
