The Government is considering beginning functions of the Constitutional Council (CC) with the minimum quorum of five members amid delays in filling the remaining five positions.

The Speaker, the Prime Minister and the Leader of the Opposition are ex-officio members of the CC. President Ranil Wickremesinghe has already nominated Minister Nimal Siripala de Silva as his nominee while Opposition Leader Sajith Premadasa has nominated Samagi Jana Balawegaya (SJB) MP Kabir Hashim as his nominee.

Under the 21st Amendment to the Constitution, the minimum quorum for any meeting of the CC is five.

Five members remain to be appointed. One MP must be nominated by agreement with the majority of the MPs representing the Government. One MP must be appointed by consensus from among the minority parties in the opposition. The other three members must be appointed from outside Parliament. Applications were called for these posts on November 14 and the deadline for applications is to expire tomorrow (28).

The government believes that the two vacant CC positions for MPs too would be filled by next week. This would give the CC seven members.

The process of appointing new members to the independent commissions is expected to begin next week.

The Sunday Times learns that attention has been drawn to replacing about 90 percent of members in the present commissions with fresh faces.
