High Court directs respondents to file objections by May 17

Transfer of Swarnamali Girls’ School Principal

Central Province High Court Judge Leon Seneviratne ordered that, if there are any objections in an application before Court, with regard to the transfer of the Principal of Swarnamali Balika Vidyalaya, the respondents should file objections on May 17, 2012.

In this case, Swarnamali Balika Vidyalaya Principal, Mrs. Mahasika Rupasinghe has been transferred by a letter dated 17.02. 2012 and informed her of the appointment of another Principal to the school by letter dated 29.02.2012.

She then appealed against the order by letter dated 26.02.2012, to the second respondent in this case, Provincial Education Ministry Secretary Sarath Premawansa.

In the petition she has filed through her Attorney, she states that, according to the Gazette Notification, with effect from 01.01.2012, the 11 respondents she has referred to in her petition, have no power to transfer her, other than the Secretary or the Additional Secretary authorised by the Public Service Commission of the Government.

In this case, the petitioner has cited the Provincial Council Education Minister Sarath Ekanayake, (who is also the Chief Minister), Provincial Education Ministry Secretary Sarath Premawansa, Provincial Education Director E.P.T.K. Ekayanake, Provincial Public Service Commission Chairman D.B. Beddewela and seven others as respondents.

Petitioner is seeking from Court a writ of mandamus to compel respondents 1 to 11, to accept the appeal made in the petition dated February 26, 2012, for a writ of mandamus to restore the petitioner to the post of Principal, and make an interim order against transferring the petitioner from Swarnamali Girls' School, until a final decision of the application before Court.

Attorney-at-Law Vasantha Wijewardene appeared for the petitioner. The respondents filed their proxies through the State Attorney.
