An accused who was charged before the Kandy Chief Magistrate A.M.Vasantha Kumar was acquitted when it was revealed that sufficient notice had not been given to the accused to lead ‘computer evidence’ under the special provisions in the Penal Code.
In this case H.M.C.H.Keitladora was accused of having obscene and lewd material downloaded to his cellular telephone.

When the trial was taken up defence attorney Nanda Senanayake submitted to Court that under the special provisions of the amended Act, 48 days notice should be given to lead evidence.

Police moved for a date to provide this evidence, but the Magistrate discharged the accused.
