Three CDs are to be played in open court as part of evidence against former army chief Sarath Fonseka in the ‘white flag’ case, according to Deputy Solicitor General Wasantha Navaratna Bandara.
He made this observation as he handed over the indictment sheet to the retired General.
The trial-at-bar, starting on September 27, will be conducted on a daily basis.
The bench comprises Deepali Wijesundara, H N P B Werawewa and Zurfick Razeen.
High Court judge Deepali Wijesundara issued summons to 20 witnesses, ordering them to appear at the next hearing.
Attorney Nalin Laduwahetty, appearing for General Fonseka, highlighted the need to protect the Colombo district MP’s parliamentary privileges.
The attorney also told the court that General Fonseka is a leader of a political party and he should be allowed to attend its meetings.
The court then ordered the two officers, who are in charge of the defendant’s security, to adhere to the request and to inform all relevant people accordingly.
The Deputy Solicitor General also requested the court to instruct the Colombo Magistrate Court’s registrar to release the records of the statements made by Sunday Leader editor Fredrica Jansz, to the High Court. These documents would be produced as evidence in this case, he pointed out.
Mr Laduwahetty and 32 lawyers are appearing for the defendant.
The attorney said he was not applying for bail at present but reserved the right to do so in future date but the State Counsel objected to the claim.
The High Court judge, however, pointed out that the issue did not arise as no bail application had been filed yet. |
