Appeal Court takes up case against MP Wigneswaran

The Court of Appeal will take up for hearing, September 15, a Writ Application filed against newly-elected Member of Parliament C. V. Wigneswaran for the failure to implement a court order delivered in 2017.

Mr Wigneswaran, who was the Chief Minister for the Northern Province, had been directed to reinstate former Provincial Council Minister B Deniswaran, but the order had not been carried out.

Accordingly, Mr Deniswaran filed a Writ Application, which will now be taken up for hearing from September 15 to 17.

Former Provincial Council Ministers Ananthi Sasheetharan and K Sivanesan have also been named as respondents in the case.

In 2007, Judges Mahinda Samayawardhena and K Priyantha Fernando delivering the judgement, held that the Chief Minister did not have the jurisdiction to remove the Minister.

Another Minister was also removed from the position and a replacement was made. The Court held that the appointment was not valid.

Mr Deniswaran was the Minister of Fisheries, Transport, Trade and Commerce, Rural Development, Road Development and Motor Traffic for the Northern Province.
