The case in the battle for control and management between the directors of Serene Pavillions Hotel, Wadduwa was taken up before Judge Mahinda Samayawardena at the Commercial High Court Colombo this week. The judge ruled that the husband and wife duo Anura Lokuhetty and Menaka Lokuhetty could be not be removed from the Board of Directors of the said hotel and could continue in the same capacity as they are major shareholders.

The petitioners Sumith Guruge and Jit Warnakulasuriya in their application had cited 13 respondents including Mr. and Mrs. Lokuhetty and alleged the couple had fraudulently tried to claim 37.78 per cent of shares held by Clive Leach and his wife Miriam Leach a British National who had invested in the Hotel.

On the previous occasion when the case was heard in the Commercial High Court, a restraining order was issued against three persons C Nethicumara, W.K. Galagoda and Nipuna Devinda Samarawickrama Lokuhetty. The Court was of the view that there was a definite instance of suppression and misrepresentation of material facts and therefore the Court directed that Mr. and Mrs. Lokuhetty continue as directors of the hotel..

Mr. Romesh De Silva P.C with Manjuka Fernandopulle and Chanaka Cooray, attorneys-at law instructed by Paul Ratnayake associates appeared for Mr. & Mrs. Lokuhetty.
