JVP application seeking arrest of ‘KP’ to be taken up on Tuesday

A Writ Application filed by the JVP seeking an order to arrest and prosecute former LTTE leader Kumaran Pathmanathan alias ‘KP’ will be taken up for hearing on Tuesday.

The petition filed in the Court of Appeal on Monday demanding the arrest and trial of ex-LTTE leader who is believed to be the head of the international wing of the Liberation Tigers of Tamil Eleam (LTTE).

Currently Mr Pathmanathan is running a Non Governmental Organization (NGO) under military protection.

Mr. Vijitha Herath, who filed the petition, requested the Court to direct the Inspector General of Police (IGP) to arrest KP since he can be indicted under provisions of the Prevention of Terrorism Act (PTA).

The application alleged, that the former international wing leader had been actively involved in money laundering, terrorist financing, drug trafficking and collecting arms with the intention of waging war against the country in the past, and therefore should be subjected to legal process.In its application, the JVP requested Court to grant an Interim Order directing the Controller General of Immigration and Emigration to prevent him from leaving the country until the final determination of the application.

It also urged Court to direct the Army Commander and Commander of security forces in Kilinochchi to submit a comprehensive report explaining the reasons for providing security to him (KP) up to now.

The petitioner noted that the IGP, the Secretary to the Ministry of Defence and the Director of Terrorist Investigation Department (TID) had failed to take action against the former LTTE leader in the past.

He therefore urged Court to issue directives to submit the relevant official document relating to the offences committed by him.

The JVP sought Writs of Mandamus to arrest Mr. Pathmanathan and produce him in Court to investigate the offences he had committed, and to initiate judicial proceedings against him.

What others say

National Freedom Front (NFF) spokesperson Muhammad Muzammil said the present government should focus on how to use the former LTTE leader to counter the threats from outside of the country rather than in arresting him.
Following the filing of the petition seeking the arrest of Mr. Pathmanathan, the Central Bureau of Investigation (CBI) of India said it would wait to see what the Court’s directive would be.
They said they had approached Interpol last month seeking to expedite the process of extradition, so they could question the former LTTE arms dealer in India.
The CBI has been wanting to question KP in connection with the Rajiv Gandhi assassination case and has complained that Sri Lanka has not co-operated with them on this issue.

Unaware of moves to arrest him : KP

While the JVP is demanding the arrest of Kumaran Padmanathan alias KP, for arms dealing and money laundering when he was a member of the LTTE, he (KP) is operating a children’s home in Kilinochchi, which he registered as a Non Governmental Organisation (NGO) soon after his release in 2012.
Mr. Pathmanathan told the Sunday Times he was not aware of any move to arrest him or which may lead to legal action being taken against him.
He said he had been running a home for war-affected children, named “Sencholai” in Kilinochchi.
“I am still in protective state custody. It is a kind of rehabilitation process I have been going throughout this period .” he said.
