Kandy MC defies court to demolish building, says complainant

A complaint has been lodged with the Central Province Governor that the Kandy Municipal Council and its officers are defying a court order and that their behaviour is tantamount to contempt of Court.

S.B. Gunasekera of Talwatta, Kandy has complained that some Kandy Municipal Council officers did not permit the implementation of a court order for the demolition of a building at Talwatta even though the Fiscal officers were at the location to carry out the order.

He charged that the Municipal Commissioner and his officers had purposely defied the court order and their action was tantamount to contempt of court.

Mr. Gunasekera said Court officials, including the Fiscal officials, arrived at the location to carry out the order, but the KMC’s Technical Officer told the Fiscal Officers that a plan had been submitted by the respondent in this case and that demolition was not necessary. The Municipal Commissioner was not present though he was informed to be present by the Registrar of the Court.

According to the complainant, there has been no delegation of power or proceedings in court on this court order.
