Swadeshi Industries declared rightful owner of Apsara Venivel brand as 12-year legal dispute ends
View(s):The Colombo Commercial High Court, in a 12-year-old case, has concluded that The Swadeshi Industries has ownership to the brand, Apsara Venivel Ayurvedic Beauty Soap. The company had sued another company for the use of this brand. Swadeshi Industries had launched ayurvedic skin care soap “Apsara Venivel” in 2000 and following its popularity, Vendol Lanka Company (Pvt) Ltd began marketing a soap with the same name ‘Apsara Venivel’ in an identical pack.
Swadeshi filed the case against Vendol Lanka Company (Pvt) Ltd in 2000 for imitating its Venivel and applied an injunction order to prevent marketing and distribution of the imitated “Apsara Venivel”. The court issued an injunction order against the defendant not to manufacture or market the product until the case is heard. After considering the evidence of the case High Court Judge Mahinda Samayawardena on June 26 ruled that The Swadeshi Industrial Works PLC is entitled to the ownership of the trade mark “Apsara Venivel”.
