Several leading NGOs including the International Centre for Ethnic Studies (ICES) and top companies are in danger of being liquidated and losing all their assets to the State if they do not comply with terms of the new Companies Act No.7 of 2007 pertaining to re-registration. According to the Act, any registered entity is in default of seeking re-registration and allotment of a new number by May 2, 2008 unless these entities obtain re-registration within six months of the date and notice by the Registrar of Companies.
The names of over 1300 companies were published by the Registrar of Companies this past week.
They were given notice in terms of sub section 3 of section 487 of the Act that their names shall be struck off the register if they fail to comply with the requirements and apply for a new number in the prescribed manner within a period of six months from the date of publication of the notice.
Among the organisations are Dr Kumar Rupasinghe’s Foundation for Coexistence, AFLAC, many other NGOs, several regional chambers of commerce, and among companies - MacLarens Marketing (Pvt) Ltd, McLarens Hotels (Private) Limited, Tea Small Holders Producers and Exporters Association, the American Chamber of Commerce (AMCHAM), Jafferjee and Sons (Private) Limited, Unilanka-Trading Company (Private) Ltd and Mahaweli Trading Company (Private) Ltd.
