AG to peruse Malaka Silva’s record

Attorney General C.R. De Silva has instructed his officers to call for the record in the High Court case where the judge had ordered that Malaka Silva be bound over for one year on ‘good behaviour’.

The order was made after a delegation of the Colombo Law Society led by its President Upul Jayasuriya met the Attorney General in his chambers this week and handed over a resolution passed by the Society condemning the ‘deliberate and calculated’ attempts to interfere with the administration of justice by the intimidation of the Mount Lavinia Additional Magistrate Dharshika Wimalasiri in a case where a suspect by the name of Malaka Silva is alleged to have caused injury to an accountant with the use of a firearm.

The Society called on the Attorney General to call for the Police information book extracts pertaining to this case and to advise the Police on the legal steps that should be taken, and to take over the prosecution of the case.

A bail application filed on behalf of Malaka Silva, son of non cabinet labour minister Mervyn Silva, will be taken before the High Court on Thursday.

The bail application was filed by his mother, J.A. Mari Luvida, and will be taken up before Colombo High Court Judge Deepali Wijesundara.

The bail application said that though the police informed court on the first occasion that a fire arm had been used in the attack on Sujeewa Senasinghe, a chartered accountant, in the second instance police had said there was no evidence to suggest that a pistol had been used.

She said that according to one of the eyewitnesses, German national Claudia, there had been no brawl between Malaka and the accountant and no weapon was used.Earlier Malaka was produced before Mt. Lavinia Additional Magistrate Dharshika Wimalasena and was re-remanded till October 3.The Additional Magistrate ordered Bambalapitiya Chief Inspector Sampath Siriwardena to submit a further report.
